OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

BY ENTERING THIS SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR FROM YOU, A CLASS-ACTION WAIVER, AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

THE “FRIGHT-RAGS FAN VIDEO CHALLENGE SWEEPSTAKES” (the “Sweepstakes”) starts at 12:01am Pacific Standard Time (“PST”) on the first day of each month in 2026 and ends at 11:59pm PST on the last day of each month in 2026 (each, a “Sweepstakes Period”) as follows:

• September 2026 Sweepstakes Period: September 1, 2026 at 12:01am EST through September 30, 2026 at 11:59pm EST (the “September Sweepstakes”).
• October 2026 Sweepstakes Period: October 1, 2026 at 12:01am EST through October 31, 2026 at 11:59pm EST (the “October Sweepstakes”).
• November 2026 Sweepstakes Period: November 1, 2026 at 12:01am EST through November 30, 2026 at 11:59pm EST (the “November Sweepstakes”).
• December 2026 Sweepstakes Period: December 1, 2026 at 12:01am EST through December 31, 2026 at 11:59pm EST (the “December Sweepstakes”).
• January 2027 Sweepstakes Period: January 1, 2027 at 12:01am EST through January 31, 2027 at 11:59pm EST (the “January Sweepstakes”).
• February 2027 Sweepstakes Period: February 1, 2027 at 12:01am EST through February 28, 2027 at 11:59pm EST (the “February Sweepstakes”).

The Sweepstakes is open only to legal residents of the United States who are at least eighteen (18) years old at the time of entry. Subject to all applicable federal, state and local laws and regulations.

Sponsor/Administrator:  FRIGHT-RAGS, INC., 70 Cascade Dr, Rochester, NY 14614 is the sponsor (the “Sponsor”) of the Sweepstakes.

ELIGIBILITY: SUBJECT TO THE ELIGIBILITY REQUIREMENTS FOR THE PRIZE (AS DETAILED BELOW).  THE SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE AT LEAST EIGHTEEN (18) YEARS OLD AT THE TIME OF ENTRY.

Employees, officers, and directors of Sponsor, ADMINISTRATOR, FRIGHT-RAGs INC. (“FRIGHT-RAGS”), and all of their respective partners, parent companies, divisions, subsidiaries, affiliates, trustees, franchisees, licensees, distributors, prize providers, advertising, promotion and public relations agencies and their respective officers, directors, employees, agents, independent contractors, representatives and agencies (collectively, the “SWEEPSTAKES Entities”) and those living in the household of same whether related or not are not eligible to participate in the SWEEPSTAKES and/or win the Prizes (as defined below).

By entering the Sweepstakes, each entrant represents and warrants that: (a) entrant is not a professional model, actor, or otherwise employed in a profession that involves being compensated for their likeness, image, or appearance; and (b) entrant is not subject to any contractual obligations, including but not limited to exclusivity agreements, non-compete agreements, or talent representation agreements, that would prevent or restrict their participation in the Sweepstakes or Sponsor’s use of any Video submitted as part of their entry.

HOW TO ENTER THE SWEEPSTAKES:  Internet access is required to enter this Sweepstakes.

During each Sweepstakes Period, Sponsor will post a Sweepstakes announcement on Sponsor’s official website, www.fright-rags.com, and on Sponsor’s official Instagram account @frightrags on Instagram (“Post”).  To enter the Sweepstakes: (1) Record a video showing your FRIGHT-RAGS or non-FRIGHT RAGS horror collection, favorite horror shirt, horror room, unboxing or collectibles (“Video”); (2) complete the official Sweepstakes entry form at www.frightrags.com/sweepstakes (the “Entry Site”); and (3) upload the Video with your entry form on the Entry Site.  Video does not have to feature FRIGHT-RAGS merchandise to be eligible.

Video must not contain: (a) weapons, firearms, or depictions of violence or dangerous activities; (b) sexual, pornographic, or obscene materials; (c) content that is defamatory, threatening, harassing, or promotes discrimination or hatred; (d) copyrighted materials, trademarks, or intellectual property of third parties without authorization including but not limited to any copyrighted music, songs or sound effects in the background; (e) other individuals besides Entrant; (f) content that violates any applicable law or regulation; or (g) any content that could harm or disparage the reputation or goodwill of FRIGHT-RAGS or any Sweepstakes Entity.  Sponsor reserves the right to disqualify any entry containing a Video that, in Sponsor’s sole discretion, violates these content requirements.

LIMIT ONE (1) ENTRY PER PERSON PER SWEEPSTAKES PERIOD. ANY ATTEMPTED ENTRIES FROM ANY PERSON IN EXCESS OF THE LIMIT STATED SHALL BE DEEMED VOID. ALL ELIGIBLE ENTRIES RECEIVED WILL BE ELIGIBLE FOR THE SWEEPSTAKES.

Use of automated entries or programs or entries submitted by third parties is prohibited and will be disqualified. Any attempt by any entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that entrant’s entries and that entrant may be disqualified at Sponsor’s discretion. Multiple entrants are not permitted to share the same email address or social media account. Normal Internet, phone and usage charges imposed by entrant’s online, or phone service may apply and are entrant’s responsibility. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win.

WINNER SELECTION AND NOTIFICATION: One (1) winner will be selected in a random drawing on or about the fifth (5th) day of the month after each Sweepstakes Period (“Drawing Date”) from among all eligible entries received by Sponsor during the Sweepstakes Period. Odds of winning will depend on the total number of eligible entries received during each Sweepstakes Period. The winner will be notified by email within forty-eight (48) hours after the Drawing Date using the account information provided on the Entry Form. If, within twenty-four (24) hours of the first attempt to contact a potential winner, that potential winner is not available, unable to be contacted, or does not respond to the attempts to contact him/her, or if the potential winner fails to comply with these Official Rules, that potential winner will be deemed to have forfeited the prize, and Sponsor may at its sole discretion award the prize to an alternate potential winner selected from all eligible entries received in the applicable drawing pool.  Alternate potential winner must satisfy all eligibility requirements. Winning a prize is contingent upon fulfilling all requirements set forth herein.

PRIZE:  One (1) winner will be selected per Sweepstakes Period. Winner will receive one (1) Gift Card to FRIGHT-RAGS. The winner of the September Sweepstakes will receive a Two Hundred Dollar ($200) electronic gift card to FRIGHT-RAGS. The winner of the October Sweepstakes, November Sweepstakes, December Sweepstakes, January Sweepstakes and February Sweepstakes will receive a Fifty Dollar ($50) electronic gift card to FRIGHT-RAGS. Gift card is valid exclusively for purchases made on www.fright-rags.com and is subject to all FRIGHT-RAGS terms and conditions.

Approximate retail value (“ARV”): $200 (September Sweepstakes) and $50 (October Sweepstakes, November Sweepstakes, December Sweepstakes, January Sweepstakes and February Sweepstakes). 

Prize is non-assignable and nontransferable, and may not be given, bartered, sold, or exchanged for cash or another prize.  Prize may not be upgraded, and no substitutions by winner will be allowed; except Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason.  Prize not won and claimed by eligible winners in accordance with these terms and conditions will not be awarded.  Winner may waive their right to receive the prize.

Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion.  Sponsor will not replace any lost or stolen prize.  Only the number of prizes stated in these Official Rules is available to be won in each Sweepstakes Period.

GENERAL CONDITIONS: Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.

Sponsor reserves the right, in its sole discretion, to modify, suspend, extend, or cancel the Sweepstakes (or any portion thereof) in the event Sponsor is prevented from executing the Sweepstakes as contemplated herein by any event beyond Sponsor’s control, including but not limited to fire, flood, earthquake, explosion, pandemic, public health epidemic or crisis, labor dispute or strike, act of God or public enemy, network or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), court order, or federal, state, or local government law, order, or regulation (each, a “Force Majeure Event”). Sponsor also reserves the right, in its sole discretion, to modify, suspend, extend, or cancel the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes or events corrupt administration, security, fairness, integrity, or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify the winner and award the prize by way of random drawing from among all non-suspect, eligible entries received up to the time of cancellation. Sponsor also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, Sponsor, at its discretion, may elect to select another winner and hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein.  Sponsor’s clock shall be the official timekeeper for the Sweepstakes.

The Sweepstakes  Entities and any and all Internet server(s) and access provider(s) (collectively, “Releasees”) are not responsible for any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Sweepstakes; inability to access the Entry Site, or any web pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including the Entry Site) or for any other reason whatsoever; typographical, printing or other errors; or any combination thereof.  All entries become the property of Sponsor and will not be acknowledged or returned.  False, fraudulent or deceptive entries or acts shall render entrants ineligible.  By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules.

PRIVACY INFORMATION:  By entering the Sweepstakes, you agree to Sponsor’s use of your personal information, as described in the Sponsor’s Online Privacy Policy (Link: https://www.fright-rags.com/pages/privacy-notice).

VIDEO RELEASE AND ASSIGNMENT: By submitting a Video as part of an entry to this Sweepstakes, each entrant hereby: (a) irrevocably assigns to Sponsor all right, title, and interest in and to the Video, including all copyrights, trademark rights, rights of publicity, and any other intellectual property rights therein, in perpetuity and throughout the world; (b) grants to Sponsor, its affiliates, successors, assigns, licensees, and designees the unrestricted, perpetual, worldwide, royalty-free, fully paid-up, irrevocable right and license to use, reproduce, modify, adapt, edit, publish, translate, create derivative works from, distribute, transmit, display, perform, and otherwise exploit the Video, in whole or in part, in any form, media, or technology now known or hereafter developed, for any and all purposes, including but not limited to advertising, marketing, promotional, commercial, and editorial purposes, without further consent, notice, or compensation to entrant, with or without entrant’s Instagram handle if provided with the Entry Form; (c) waives any and all moral rights, rights of attribution, rights of integrity, and any other similar rights in the Video; and (d) releases and forever discharges Sponsor and the Sweepstakes Entities from any and all claims, demands, causes of action, and liabilities arising out of or related to the use, publication, or exploitation of the Video, including but not limited to claims for defamation, invasion of privacy, right of publicity, copyright infringement, or any other intellectual property claims. Entrant acknowledges and agrees that Sponsor is under no obligation to use any Video and may, in its sole discretion, choose not to use any Video for any reason.

RELEASE AND LIMITATIONS OF LIABILITY:  By participating in this Sweepstakes, entrants agree that the Sweepstakes Entities are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries.  No more than the stated number of prizes will be awarded.

BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT THE SWEEPSTAKES ENTITIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND ENTRANTS AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS SWEEPSTAKES ENTITIES AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR PRIZE DELIVERY.    

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.  CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

PUBLICITY:  EXCEPT WHERE PROHIBITED BY LAW, EACH WINNER GRANTS TO THE SPONSOR, ADMINISTRATOR, FRIGHT-RAGS, AND ALL OF THEIR RESPECTIVE PARTNERS, PARENT COMPANIES, DIVISIONS, SUBSIDIARIES, AFFILIATES, TRUSTEES, FRANCHISEES, LICENSEES, DISTRIBUTORS, ADVERTISING, PROMOTION AND PUBLIC RELATIONS AGENCIES (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR) AND THOSE ACTING PURSUANT TO SPONSOR AND ADMINISTRATOR’S AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, EACH WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON THE INTERNET, TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.

DISPUTES/CHOICE OF LAW:  Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Monroe County, New York; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased This content is governed by the laws of the State of New York in the United States of America, without respect to conflict of law doctrines.
